1 The appellant, Lawrence Okis Stringfellow, was tried by jury and convicted of Attempted Burglary, First Degree, After Former Conviction of a Felony (21 O.S. 1981 ?? 42 [21-42], 51 [21-51] and 1431 [21-1431], 1436 [21-1436]), in Creek County District Court, Case No. CRF-84-58, before the Honorable John Maley, District Judge. The jury set punishment during the second stage at nine (9) years imprisonment. Judgment and sentence was imposed accordingly. We affirm as hereinafter modified.
